1. General

1.1. These terms and conditions apply to all deliveries. Placing an order implies acceptance of these terms and conditions of sale.

2. Delivery and shipping

2.1. Delivery will be made while stocks last.

2.2. Orders are shipped Monday through Friday, excluding holidays. Dark Temptation is not responsible for unforeseen delays.

2.2. The items will be sent to the delivery address indicated by the customer, with the shipping cost depending on the country and at their own risk.

2.3. If the items cannot be delivered, the contract will be automatically terminated. The seller is obligated to notify the customer in writing before the delivery deadline. In the case of partial delivery, each delivery will be considered a separate sale.

2.4. The delivery obligation will be fulfilled, unless proven otherwise, once the goods delivered by the seller have been offered to the buyer. In the case of home delivery, the carrier’s report containing the refusal of acceptance constitutes conclusive proof of the offer of delivery.

3. Price

3.1. Dark Temptation cannot guarantee the complete absence of errors in the store. The store may contain typographical errors, mistakes, and inaccuracies regarding the price, availability, or details of an item. No liability is assumed for the consequences of such errors.

3.2. Dark Temptation makes every effort to ensure the accuracy of prices, but cannot guarantee that errors have not occurred. In the event of a price error, Dark Temptation will allow the customer to accept the new price or cancel the order.

3.3. Prices shown are valid at the time of publication and may be subject to change. These prices do not include shipping costs, but do include Belgian VAT (21% or 6%).

3.4. All prices are per piece, unless otherwise stated.

3.5 If shortly after acquiring a product it turns out that a product already acquired has been reduced in price, the customer will not be able to claim a refund of the price difference.

4. Right of withdrawal

4.1. In the case of a purchase by a consumer, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the consumer has the right to inform the seller of their intention to cancel the order, without penalty or justification, within 14 working days of receiving the goods. Before returning the goods, the buyer must notify the seller using the contact form or email. Returns must be in their original packaging (including all accessories and documentation) and in perfect condition.

5. Complaints or disputes

5.1. Complaints or disputes must be reported within 14 days of delivery. If the complaint is deemed justified, our liability is limited to replacing the merchandise. The seller’s liability is limited to the amount actually paid for the order.

6. Returns

6.1. The merchandise can be returned up to 14 days after receipt.

6.2. Dark Temptation recommends using a courier service when returning merchandise to allow for package tracking.

6.3. Dark Temptation is not responsible for refunds for lost, stolen, or damaged products.

7. Overdue payments

7.1. In the event of non-payment, interest will automatically accrue on the outstanding amounts at a rate of 1% per month from the invoice date, without prior notice. If a reminder sent by mail is not answered within 14 days, a fixed penalty equivalent to 10% (ten percent) of the outstanding amounts will be charged, with a minimum of €50 (fifty euros) and a maximum of €2,000 (two thousand euros).
